Privacy policy

The protection of your privacy is very important to us. 

If we or third parties with whom we coopeate collect or process personal data, we comply with the provisions of the Federal Act on Data Protection (FADP) as well as other applicable foreign data protection laws, in particular the General Data Protection Regulation (EU) (GDPR)


Website

The website www.hanhartlaw.ch can be used without disclosing personal data. Standard information about user accesses is stored on the website server. This includes the following information:

  • IP address from which www.hanhartlaw.ch is called up;
  • information on which subpage was called and if the call was successful;
  • Date and time of the page view (including time zone), if the page is accessed via a link
  • the source page (HTTP referrer), if your browser sends this information as well
  • the web browser and operating system (user agent) used to access the site;
  • if necessary, technical log entries about firewall, antispam/antivirus and load balancer.

This data is used to ensure a smooth connection setup, the comfortable use of the website, the evaluation of system security and stability as well as for other administrative purposes.

We use  Google Maps for embedding the directions map. This service is provided by the American Google LLC, with the Irish Google Limited Ireland being responsible for users in the European Economic Area (EEA) and Switzerland. This service may transfer data (e.g. by means of cookies) to Google in the USA. Further information can be found  in Google's privacy policy .


Cookies

We may use cookies on the website. These are text files that are stored on your computer and enable the analysis of the use of our website. You can configure your browser so that no cookies are stored on your computer or so that a message always appears before a cookie is installed. A complete deactivation of cookies can lead to the website not functioning or not functioning completely. The data processed by cookies is required for the above-mentioned purposes to protect our legitimate interests.


Lawyer's Engagement

If you engage us as your lawyers, your name and contact information (address, phone numbers, e-mail address), as well as other information necessary for the execution of the mandate, will be collected.

The collection of this data is carried out,

  1. to be able to identify you as a client;
  2. to be able to advise and represent you as a lawyer;
  3. for correspondence;
  4. to issue invoices;  
  5. to settle potential liability claims and to file legal action.

We may collect personal data about your credit rating in order to protect us from payment defaults.

Data processing is carried out at your request and is necessary for the appropriate performance of the lawyer’s engagement and for the mutual fulfilment of obligations arising from the latter.

The personal data collected by us based on the engagement as a lawyer will be stored until the expiration of the statutory retention period for attorneys (ten years after the end of the calendar year in which the lawyer’s engagement was terminated) and deleted thereafter, unless we are obliged to store the data for a longer period of time due to tax and/or commercial law retention and documentation obligations or you have agreed upon a longer period of storage.


Data security and Legal privilege

We take technical and organizational measures to adequately protect your data from any kind of misuse (including manipulation, data loss, destruction, unauthorized access). When you access our website, the SSL encryption method applies.

However, we cannot guarantee data security or compliance with the legal privilege when you use our website or send us an unencrypted e-mail. For encrypted communication with me, please use IncaMail, Threema (W8YMRACK) or, after prior consultation, other forms of encrypted communication.


Disclosure of Third Parties

We will only pass on your data to third parties if you expressly consent to this, if there is a legal obligation or permission to do so, if the passing on is necessary for the collection, exercise or defence of legal claims or for the handling of the client relationship with you. 

For accounting purposes, we work together with a Swiss trust company, which receives information in connection with invoicing. 


Your Rights

You have the right 

  1. of acces to information on the type, content and purpose of your stored personal data and on how this data is processed;
  2. to restriction of the processing of personal data;
  3. to rectification of personal data;
  4. to deletion and blocking of personal data; 
  5. to portability of personal data (within the scope the GDPR applies); 
  6. to revoke your consent granted and to object to the processing of data based on legitimate interests or on the performance of the lawyer’s engagement.

If you believe that the the processing of your data violates the data protection laws, you can report this to me or the supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).
